Arvind is a key member of the firm’s Dispute Resolution practice and leads it in Bangalore. He has vast experience in handling a variety of disputes ranging from commercial to constitutional. He has appeared before Courts and Tribunals at different levels of litigation including trial, appellate and regulatory. Arvind has also appeared before various High Courts and the Supreme Court of India. He also has significant experience in arbitration and issues relating to judicial intervention of arbitral matters.
Arvind’s skill set includes working out aggressive litigation strategy with foresight on protecting the clients’ interests and expeditious settlement of disputes. Arvind’s forte has been handling commercial and corporate disputes at the trial appellate stages.
Arvind has been practising in the Karnataka High Court at Bangalore since 1994 and has gained significant bench recognition. In 2003 he was appointed as the Assistant Editor to the Karnataka Law Reporting Council, headed by the Chief Justice of Karnataka. Arvind served on the editorial team until 2006 preparing headnotes of reportable judgments of the Karnataka High Court and Supreme Court.
Before joining ALMT Legal, Arvind had worked with a leading law firm in Bangalore and had thereafter set up a litigation team of his own.
Recent experience
- Execution of Foreign Decree - Obtained clearance from an Executing Court to proceed with, and successfully executed a decree issued by a British Court for GBP 175,000 against a builder in Bangalore.
- Injunction against Sale - Filed, and conducting a civil suit seeking permanent injunction against a MNC in respect of the import, manufacture, sale, distribution and marketing of deo sprays with the brand name “Axe Inxtinct” on the ground of infringement of trademark.
- Injunction against encashment of bank guarantee - Obtained injunction against Madhya Pradesh Road Development Corporation against encashment of bank guarantee of INR 50 million furnished by the client.
- Criminal prosecution against CEO of MNC - Filed, and conducting proceedings before the Magistrate’s Court against a large Indian based telecom MNC in respect of offences under Sec.203 of the Indian Penal Code, resulting in issuance of summons to the Group Chairman, CEO and other officers of the company.
- Aircraft lease dispute - Represented a major South Indian Airlines before the Delhi High Court in a Writ Petition in respect of disputes relating to aircraft leasing with a British MNC. Aircraft lease dispute
- Constitutional ValidityConducting proceedings in a Writ Petition filed Art. 226 of the Constitution challenging the constitutional validity of the Employees Provident Fund (Third Amendment) Scheme, 2008 on behalf of one of the largest cargo companies of India.
- Company Liquidation - Conducting proceedings in various petitions filed under Sec.433-434 of the Companies Act for liquidation of companies involving amounts in excess of INR 50 million.
- Scheme of Amalgamation of Companies - Representing clients in various petitions under Sec.391-394 of the Companies Act for obtaining sanction of the High Court in respect of schemes of amalgamation of two or more companies.
- Copyright Dispute - Representing a client in an appeal in respect of the right to make “Version Sound Recording” of musical works in terms of Section 52(1)(j) of the Copyright Act.
- Tax Classification - Representing a major manufacturer of electronic goods in a Sales Tax Appeal involving interpretation of whether LCD Data Projectors would be “electronic goods” or “computer peripheral” under the Karnataka Sales Tax Act, 1957.
- International Scrap Exports Dispute - Defending client in arbitration proceedings before a retired Supreme Court Judge in claims exceeding USD 250 million pertaining to import and export of non-ferrous scrap.
- Infrastructure Development Dispute - Representing client in a claim for USD 3 million against the Airports Authority of India pursuant to termination of contract for construction of airport terminal.
- Corporate Disputes - Defending client in arbitration proceedings in respect of disputes arising due to alleged breach of Shareholders Agreement and entering into construction contracts.
- Lending Agreement Disputes - Defending client in arbitration proceedings involving disputes of failure to repay loan borrowed for purchase of equipment and machinery in construction projects.
